Pa. Supreme Court Rules Gov. Rendell Misused Line-Item Veto On Family Planning Funding In 2005

The Pennsylvania Supreme Court on Tuesday ruled that Gov. Ed Rendell (D) misused his line-item veto authority in 2005 to remove miscarriage counseling language from a budget bill, the AP/Philadelphia Inquirer reports. The consentaneous decision, which overturned a lower court ruling, aforementioned that "language-only" vetoes ar not permitted, meaning Rendell is non allowed to strike speech in a budget card without canceling the associated funding in the measure (Scolforo, AP/Philadelphia Inquirer, 8/20).

The language, which was approved in 2005 by the state Legislature, would experience subjected whatever federal class planning support to the same restrictions as state family provision funds -- a necessity under a 1996 state law that says such money "shall not be used to promote, perform or look up for abortions, or engage in abortion counseling." Rendell at the time said restricting the use of federal Medicaid funds likely violates the state constitution and federal law (Daily Women's Health Policy Report, 8/14/06).

Former state House Speaker John Perzel (R) and Robert Jubelirer, the state Senate's ranking Republican at the time, filed the separation-of-powers lawsuit. Senate Republican attorney Steve MacNett said that the financial year 2005-2006 money is presumably all spent just that the ruling testament influence future budget negotiations. Rendell representative Chuck Ardo said that the case is "complex," adding that the governing wanted to review the ruling before making extra comments. According to the opinion by Chief Justice Ronald Castille, the Rendell administration told the court that preventing line-item vetoes of nomenclature will cause the General Assembly to "once once again 'load up' large appropriations with obnoxious conditions and put the governor (to) a Hobbesian choice" (AP/Philadelphia Inquirer, 8/20).

BBCPO/Noseda, Bridgewater Hall, Manchester

The young Johannes Brahms had little idea what he was letting himself in for when he turned up at the door of his musical hero, Robert Schumann, in 1853. The satisfaction of being hailed as the future of German music must have been tempered by the exhausting soap opera of life with the Schumanns: acting as babysitter, nursemaid and go-between for Robert and his wife Clara, with whom Brahms fell passionately in love.

The turmoil of the period was poured into the opening movement of Brahms's First Symphony, which seems partly a tormented love letter (Clara noted that "it begins somewhat severely, but I have grown used to it") and partly an attempt to live up to the inflated hopes of his mentor.

The BBC Philharmonic began its survey of the Brahms-Schumann axis last season, pairing a complete cycle of Schumann's symphonies with concertos and works for solo instruments by Brahms. Now the emphasis is reversed, with Schumann's somewhat overlooked Cello Concerto sharing the bill with Brahms's First Symphony. The disparity in scale tells you almost everything you need to know about the two composers: Schumann's concerto took just over two weeks to complete, while Brahms's symphony required almost 20 years. But though Schumann's modest concerto lacks the gruff dynamics of Dvorák or the swelling emotion of Elgar, cellist Paul Watkins makes a persuasive case for its plangent, understated lyricism.

The Brahms, by comparison, is pure drama. Gianandrea Noseda sometimes seems in danger of being blown away by the power he unleashes, furiously rotating his arms as if trying to maintain his balance. Yet he never allows the works to sound like a mismatch, presenting them instead as an unbroken train of pure Romantic thought.

· Broadcast on Radio 3 tomorrow at 7pm.

Jamie's Oliver's Auissie headquarters gutted

Celebrity chef Jamie Oliver's Melbourne headquarters have been gutted in a blaze overnight.

The office of Oliver's Fifteen restaurant, which featured in a reality television series when it was launched two years ago, was engulfed in flames when firefighters arrived after 8.30pm yesterday.

About 50 firefighters took 40 minutes to control the blaze at 101 Collins Street, which destroyed the Fifteen office and two other offices on the first floor of the building.

Nightspot and live music venue The Cherry Bar was also damaged in the blaze.

However the fire did not reach the Fifteen restaurant, which is at 115-117 Collins Street.

The Fifteen office also runs the Fifteen Foundation, which gives young people with tough backgrounds an opportunity to train and be employed as apprentice chefs.

Metropolitan Fire Brigade commander Lou Mele said the damage bill could reach $1 million.

"Pretty much the whole first floor is gutted," Mr Mele said.

"That's where the fire started, on the first floor."

The blaze started on the first floor, gutting the interior of the three offices and collapsing part of the iron roof, but leaving the building otherwise structurally intact, Mr Mele said.

He said the The Cherry Bar suffered smoke, heat and water damage.

Fire investigators are today working to pinpoint where and how on the first floor the fire started.

No other buildings were damaged in the blaze.

Nas screens video for album's first single

B&W video inspired by old Spike Lee films

NEW YORK -- Rapper Nas has revealed the video for "Be a N***** Too," the lead single from his upcoming untitled album, due July 1 via Def Jam. The clip was unveiled for media Thursday night at the Tribeca Grand Hotel in New York.
The treatment for the black-and-white video, directed by Rik Cordero, features Nas looking at his reflection through a mirror and rapping about racism, politics and religion, among other things, while images of people of different races sporadically appear throughout. "We all black within, OK/we all African, OK," the Queensbridge rapper rhymes over a piano-heavy beat.
Towards the middle of the video, a scene of what appears to be a white slave owner pointing a gun at a black male slave emerges, right before the song shifts into its chorus: "They like to strangle n*ggers / blaming n*****s/hanging n*****s/still you wanna be a n***** too?"
At the end, Nas, still facing the mirror, says, "F*** you. You had it all, and you threw it all away." When asked about the significance of that portion of the video, Nas said the concept was Cordero's idea and he "just went with it."
According to Cordero, the clip was inspired by old Spike Lee films. It features cameos by Latina rapper La Bruja and actor John Cho ("Harold and Kumar Go to White Castle"), among others.
Although the album won't be titled "N*****" as originally planned, its cover -- an image of Nas' bare back with welts similar to the ones slaves endured from lashings -- "speaks for itself. It says 'n*****' real loud," he said.
That image was on display in the room during the screening last night, but at the time was not being trumpeted as the official cover. A Nas spokesperson confirms it will be used as such.
